1. Terms of Sale

By placing an order with Color Atelier Paint (“Color Atelier,” “we,” “us,” “our”), you agree to be bound by these Terms of Service and all applicable policies referenced herein.

You represent that you are at least 18 years old, or that you have a parent or legal guardian’s permission to purchase from us.

2. Products; No Warranty; Natural Variation

Color Atelier products are mineral-based and may display natural variation in appearance, color, movement, and texture. These variations are inherent to the material and are not considered defects.

While we provide detailed information, installation guidelines, and technical support, the buyer is solely responsible for determining whether the product is suitable for their intended use, environment, substrate, and installation conditions. Recommendations provided by Color Atelier are based on typical scenarios and may not apply to your unique situation.

No Express or Implied Warranty

Except where prohibited by law:

COLOR ATELIER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Because installation and application conditions are outside of our control, we do not guarantee results, performance, texture, finish, or color outcomes.

3. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to property damage, personal injury, loss of profits, delays, or installation-related issues.

  • Our total liability, whether in contract, tort, or otherwise, is expressly limited to the replacement of product quantities proven to be defective and returned prepaid to us with proof of purchase and batch number.

  • Claims must be submitted in writing within 30 days of when the issue was discovered or reasonably should have been discovered.

Under no circumstances shall Color Atelier be responsible for damage resulting from:

  • Improper installation

  • Use contrary to written instructions

  • Use outside recommended environments

  • Modifications, mixing with other products, or misuse

Handling and use of the products are beyond our control; therefore, all risks are assumed by the buyer.

4. Remedies

Your sole and exclusive remedy for defective product is limited to replacement of the defective quantity. No other remedy—refund, repair, compensation, or damages—is available.

This limitation survives product installation and use.

5. Pricing, Availability & Order Acceptance

  • Prices are current at the time you place an order and may change without notice.

  • Payment, taxes, shipping charges, and fees are clearly disclosed at checkout.

  • We reserve the right to refuse or cancel an order for any reason, including product unavailability, suspected fraud, or inaccurate information.

  • If a product becomes unavailable, we may cancel the order and issue a refund or offer a comparable alternative.

6. Payment Terms

  • All products remain the property of Color Atelier until payment is received in full.

  • Payments are processed through secure, third-party payment gateways; card data is transmitted over SSL encryption and is never stored on our servers.

  • Please review the payment processor’s terms and conditions, as those apply to your transaction.

7. Local Taxes, Duties & Fees

Local taxes, duties, and import fees may apply depending on your delivery location. All such charges are the responsibility of the customer.

8. Personal Information

Your personal information is handled in accordance with our Privacy Policy, which governs how we collect, use, store, and share data. By placing an order, you consent to such processing.
We do not sell personal information and do not share it with third parties except as necessary to fulfill your order (e.g., shipping carriers, payment processors).

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, unless otherwise required by law.
Any disputes shall be resolved in the courts located in California.
